Arizona Electric Scooter Laws: What You Should Know

Electric scooters are a popular and convenient way to get around, almost to the same extent as traditional bicycles. While this market is still growing, not everyone is familiar with Arizona’s electric scooter laws. Understanding what the law says about this particular mode of transportation will make sure you know your rights if you get into an accident.

What Are the Electric Scooter Laws in Arizona?

Arizona statute §28-819 states that “an operator of an electric bicycle or an electric standup scooter is granted all the rights and privileges and is subject to all of the duties of a person riding a bicycle.” This means you can use an electric scooter without the need for a vehicle title, registration, insurance or even a license.

If you get into an accident on an electric scooter in Arizona, the legal process is also the same as with a bicycle accident. However, there may be different evidence you can use due to the unique nature of an electric scooter. It is worth your while to consult with a specialized electric scooter lawyer to make sure you recover maximum compensation from the at-fault driver.

Are Electric Scooters Street Legal in Arizona?

Electric scooters are completely street legal in Arizona. People riding electric scooters have the same rights as bicyclists, which means they can make full use of the road just like any motor vehicle driver. Even so, electric scooters should use designated bike lanes whenever they are available.

While bicycles and electric scooters have full use of the road, it is important to remember that neither is permissible on pedestrian sidewalks. This Arizona scooter law may differ in certain cities or counties, but it is generally considered unsafe and illegal to use an e-scooter on a sidewalk where it might endanger pedestrians.

Keep in mind that bicyclists and electric scooter riders must completely obey the same traffic laws as other motorists. This includes following traffic signals, making lane-change signals and obeying stop or yield signs.

How Old Do You Have To Be To Ride an Electric Scooter in Arizona?

Unlike with traditional bicycles, certain local jurisdictions in Arizona place a minimum age for operating an electric scooter on the road. In Phoenix, for example, you have to be 16 years old to ride an e-bike or electric scooter. This law exists to promote safety and to align the requirement with the state’s legal driving age.

The age requirement also coincides with the state’s helmet laws. While you can operate an electric scooter if you are at least 16, you must wear a helmet if you are below 18 years of age. Keep in mind also that e-scooter vendors can choose to withhold rentals to individuals who are younger than 18.
